Ovation Architectural Guidelines

The Ovation Board of Directors on 6/21/2023 voted 5-0 to include a Builder's Compliance Deposit of $5,000 to cover legal action to repair damages to Ovation gates, sidewalks, curbs, roads, vehicles, bollard lights, homes, irrigation lines, irrigation heads, HOA landscaping, etc...  The $5,000 will be reduced for fines for utilizing the residential gates with cameras, trash pickup around the construction lot blowing in the road or on other HOA property, removing sand from the HOA streets & sidewalks, or any other violations and the GC will then replenish any deductions made to the $5,000.  Upon completion of all construction activities the Builder may request a full refund of anything that has not been deducted from the $5,000.  Each Builder will also name Ovation HOA on their General Liability policy so we can submit claims for any damages. This goes into effect on 7/21/2023 for every builder with a home under construction in Ovation.

The Ovation Board of Directors voted 5-0 to adjust the DRB Guidelines in March 2022 and 5-0 again in August 2022 then waited 30 days to make the new guidelines effective per the governing documents. The changes were made to address the long term parking issues that we face as a neighborhood with regards to the safety and enjoyment for all who visit Ovation.  

Visitors and owners typically visit the beach with their 19' Suburban or 20' truck and 4 bedroom houses sometimes have 4 couples who bring 4 of these vehicles.  Previously our single family homes were smaller in design and in many cases accommodated 2 smaller cars being parked on the property while the gravel parking spaces are not available for overnight parking, so the BOD is trying to properly plan appropriate space for the remaining 95 homes that will be built in Ovation over time.

Landscaping was originally 5-10% of lot + house cost or $75,000 to $150,000 in most cases until the original board changed it to $5,000 in plants back in 2011.  Over the past 11 years the cost of plants has doubled and many homeowners are spending $15-25,000 on landscaping so we adjusted the new minimum to $7,500 in plants which does not include irrigation, pine straw, sand, gravel, pavers, labor, etc...

The reviewer fees were adjusted from the original $2,000 to $4,000 because of the time required to go through each set of plans multiple times and the CPI has increased significantly over the past 15 years.

General Contractors are to keep all sand and garbage on their lot at all times.  During Hurricane warnings all dumpsters must be emptied and all loose materials must be tied down in the carport so they do not damage the neighborhood.  Any subcontractor trailer that remains overnight must be on the construction lot and not parked in the HOA temporary spots.  All garbage dumpsters and outdoor toilets must be on the construction lot and not in the roads, HOA parking spots, blocking HOA sidewalks, etc...  

Lifts and cranes must stay on the construction site to avoid damaging neighboring vegetation which causes a loss of sand to that property when the wind blows.  Any leaks on the roads or broken sidewalk are to be repaired by the General Contractor as soon as practical.  Subcontractors are prohibited from using the restrooms or facilities at both pools at all times and are subject to being banned from Ovation for violations.

Gulf County has approved the permeable pavers so homeowners can use these for their sidewalks, driveways, outdoor showers, and garbage can storage areas even if they are at 30% permeability with their home design.  Homeowners who have tried gravel are quickly removing and replacing with these new pavers as the gravel damages floors in the house and ends up all over the road and landscape areas with wind and traffic.

Multiple homes are going to replace their galvalume roofs because they rust in our environment unless professionally washed every 6 months.  Homes under construction should select 100% aluminum standing seam roofs to eliminate a $96,500 replacement quote in 10-12 years.
